End User Licence Agreement

n8-m8 EULA

Read this first: this EULA is intended to protect the Licensor to the maximum extent permitted by law. It cannot and does not exclude rights that cannot legally be excluded, including applicable Australian Consumer Law rights.

1. Parties and acceptance

This End User Licence Agreement is between you and the current publisher and licensor of n8-m8 (Licensor). By downloading, copying, installing, deploying, accessing, sponsoring, paying for, or using n8-m8, you accept this EULA.

If you do not accept this EULA, do not use n8-m8.

2. Non-excludable rights

Nothing in this EULA excludes, restricts, or modifies any consumer guarantee, statutory guarantee, warranty, right, or remedy that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law or any other applicable law (Non-Excludable Rights). Any exclusion or limitation in this EULA applies only to the maximum extent permitted by law.

Where n8-m8 is supplied as goods or services not ordinarily acquired for personal, domestic, or household use or consumption, and it is lawful to do so, the Licensor limits liability for breach of any Non-Excludable Right to resupplying the software or services, or paying the cost of resupply, at its option.

3. Licence model

n8-m8 is licensed, not sold. It is source-available and not OSI open source.

Personal and non-commercial use

If you qualify for personal, homelab, educational, or non-commercial use, the Licensor grants you a limited, non-exclusive, non-transferable, revocable licence to use n8-m8 for that purpose.

Commercial sponsor licence

Commercial use requires an active commercial sponsor licence. A commercial sponsor licence means an active paid sponsorship, membership, invoice, subscription, or written licence confirmation issued or accepted by the Licensor for the applicable tier.

Commercial use includes business use, revenue-generating automation operations, paid client work, MSP or agency use, managed-service use, team use, or use by or for a company, partnership, government body, non-profit, or other organisation.

Honour-system design

The software does not use remote licence enforcement or include licence activation, licence-key verification, phone-home licence checks, licence telemetry, outbound licence audit beacons, or a remote disable mechanism. It sends the Licensor no automatic deployment inventory, licence state, or licence-check request. The Licensor cannot use n8-m8 to automatically discover a deployment or verify its licence status.

The Licensor deliberately relies on users to choose the correct licence. This honour-system design does not change the legal scope of the licence or grant commercial-use rights where an active commercial sponsor licence is required.

4. Restrictions

You must not sublicense, sell, rent, lease, redistribute, repackage, white-label, host as a service, provide as a standalone service to third parties, remove notices, or use n8-m8 to monitor systems you are not authorised to monitor, except as expressly permitted in writing by the Licensor.

You must not reverse engineer, decompile, disassemble, or modify n8-m8 except to the extent expressly permitted by this EULA or mandatory applicable law, including non-excludable rights relating to computer programs under the Copyright Act 1968 (Cth).

5. Self-hosted operation and sensitive data

n8-m8 is self-hosted. The Licensor does not operate, host, manage, monitor, secure, or back up your deployment.

n8-m8 does not intentionally fetch n8n credential secret payloads. However, workflow names, node names, credential names, execution logs, payloads, webhook URLs, error messages, operational metadata, screenshots, support bundles, and configuration files may contain sensitive, confidential, personal, or regulated information depending on your n8n setup.

You are solely responsible for token scope, access control, authentication, TLS, network exposure, backups, retention, redaction, privacy compliance, and deciding whether n8-m8 is suitable for your environment.

6. Best-effort monitoring only

n8-m8 is a best-effort monitoring and visibility tool. It does not guarantee detection of every failure, delay, outage, stale workflow, missed execution, configuration problem, security issue, data exposure, or other condition. It may produce false positives, false negatives, stale information, incomplete data, or no alerts at all.

You must not rely on n8-m8 as your only monitoring, alerting, backup, audit, compliance, incident-response, or business-continuity system, especially for critical workflows.

7. No support or professional services

Unless separately agreed in writing, n8-m8 is supplied without support, maintenance, updates, bug fixes, security patches, response times, uptime commitments, deployment services, hosting, consulting, managed services, professional advice, or an SLA.

8. Warranty disclaimer

Subject to Non-Excludable Rights and to the maximum extent permitted by law, n8-m8 is provided “as is” and “as available” with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for purpose, title, non-infringement, accuracy, security, reliability, availability, compatibility, or error-free operation.

9. Liability exclusion and cap

Subject to Non-Excludable Rights and to the maximum extent permitted by law, the Licensor is not liable for direct, indirect, incidental, special, consequential, exemplary, punitive, or other damages arising from or related to n8-m8, including loss of data, loss of profits, loss of revenue, business interruption, missed alerts, false alerts, security incidents, privacy incidents, credential exposure, corruption or deletion of workflows, downtime, dependency failures, n8n changes, Docker or platform issues, or costs of substitute goods or services.

For liability that cannot lawfully be excluded but can lawfully be limited under the Australian Consumer Law or any other applicable law, the Licensor limits its liability to the maximum extent permitted by law. For services, this includes, where lawful, supplying the services again or paying the cost of supplying the services again. For goods or software treated as goods, this includes, where lawful, repair, replacement, resupply, or paying the cost of repair, replacement, or resupply.

For all claims other than claims involving Non-Excludable Rights, and to the maximum extent permitted by law, the Licensor's total aggregate liability is limited to: for free personal or non-commercial use, AUD $0; and for paid commercial sponsor licence use, the total amount you actually paid to the Licensor for n8-m8 commercial-use rights in the 12 months before the event giving rise to the claim. If no amount was paid to the Licensor for n8-m8 commercial-use rights, the paid-use cap is AUD $0. Multiple claims, incidents, deployments, users, workflows, tenants, or n8n instances do not increase this cap.

10. Indemnity

You indemnify the Licensor against third-party claims, losses, liabilities, costs, and expenses arising from your breach of this EULA, unlawful use, unauthorised monitoring, data, deployment environment, n8n instances, credentials, workflows, connected services, modifications, combinations with other systems, or violation of third-party rights. This indemnity does not apply to the extent caused by the Licensor's fraud, wilful misconduct, or liability that cannot lawfully be excluded.

11. No affiliation with n8n

n8-m8 is independent from n8n. It is not affiliated with, endorsed by, sponsored by, or an official product of n8n GmbH. The name “n8n” is used only to identify the third-party software with which n8-m8 integrates.

12. Termination

Your legal permission to use n8-m8 ends if you breach this EULA. Your commercial-use rights also end if the applicable commercial sponsor licence expires, is cancelled, is refunded, or payment fails. The software does not automatically deactivate or remotely disable itself. When those legal rights end, you must stop all commercial use immediately.

13. Governing law

This EULA is governed by the laws of Queensland, Australia, subject to any mandatory laws and Non-Excludable Rights that apply. For commercial users that are not consumers or small businesses under the Australian Consumer Law, the courts of Queensland and Commonwealth courts sitting in Queensland have exclusive jurisdiction, except where the Licensor seeks urgent injunctive relief or enforcement of intellectual property rights elsewhere.
